1. Project Identification

2. Object and Service Description
Aquarium SMP is a community Minecraft Java server (version shown in footer) offering multiplayer, project management, litematic library with 3D viewer, historia/chronicles and private /app for members. It is a free volunteer-run service; we may modify, suspend or discontinue features with reasonable notice.
3. Accounts, Invitations and Minimum Age
Access to /app requires a valid invitation and registration with Minecraft username + password (min. 8 chars, uppercase, lowercase and number). You are responsible for credentials and activity under your account; report breaches to [email protected]. Staff may suspend/delete accounts for breach. Minimum age: 14 (see Privacy §10); if younger, need parent/guardian consent. Roles: member, trial (no vote), admin/founder.
4. User Conduct
You agree not to: - Break laws or infringe third-party rights, harass or promote hate. - Interfere with server/website, attempt unauthorised access, mass scraping or bypass rate limits/access controls. - Upload malware, spam or illegal content. - Share credentials or access codes (aq-known) outside authorised scope. Breach may lead to expulsion and content removal, with warning except for severe cases.
5. User-Generated Content — License & Moderation
You retain ownership of what you upload. By publishing you grant Aquarium SMP a non-exclusive, royalty-free, worldwide, revocable licence to host, reproduce, adapt (e.g. optimise images to WebP), display and serve via R2/proxy, solely to operate and promote the service. Revocable by deleting content or account (no retroactive effect). You warrant you own or have rights to share. We apply notice-and-action: if illegal content is detected or notified ([email protected]), we remove/block it and notify the author. No general monitoring.
6. Third-Party Intellectual Property
Our software, design and texts are protected by IP. Minecraft/Mojang/Microsoft trademarks belong to their owners. Third-party litematics linked or uploaded are the author's responsibility.
7. Availability and Limitation of Liability
Service 'as is' (art. 1604 Colombian Civil Code). No guarantee of 24/7 uptime. To the extent permitted by law, our liability is limited to USD 100 or the amount actually paid (as it is free, to proven direct damage). Nothing limits liability for wilful misconduct, gross negligence or non-waivable consumer rights (Law 1480 of 2011).
8. Third-Party Links and Services
We may link to Discord, R2, Resend or others. We do not control those services; their use is governed by their own terms and privacy.
9. Changes
We may update these terms for technical, legal or service reasons. We publish the new version dated; for material changes we give 15 days notice via banner/web and, for members, via email/Discord when possible. Continued use after effective date means acceptance; if you disagree, cease use and you may request account deletion.
10. Complaints and Dispute Resolution
For complaints email [email protected]; we reply within 15 business days (Law 1480). Consumers may use the Superintendence of Industry and Commerce (SIC) — www.sic.gov.co. We seek amicable resolution before court.
11. Governing Law and Jurisdiction
These terms are governed by Colombian law (Law 527 of 1999, Law 1581 of 2012 and Decree 1377 of 2013, Law 1480 of 2011). Jurisdiction: Bogotá D.C., Colombia, waiving any other forum.
